A recent study performed by a team of physicians at the Massachusetts General Hospital revealed that plaintiffs in medical malpractice cases hardly ever win when the case reaches a jury verdict – and only 4.5% of all claims filed by malpractice victims ever get to that point. Out of those cases that do reach a jury, nearly 80% of the verdicts favor the medical practitioner.
Led by Anupam Jena, MD, PhD, the team of researchers analyzed over 10,000 closed medical malpractice cases from across the United States. Overall, around 54% of the cases that went to trial were dismissed, and the rest were settled.
Unfortunately, cases never close quickly. The average amount of time required to resolve a medical malpractice claim was 19 months according to the study. For those who litigated in court, that average rises to 25 months – and beyond for those few cases that progressed to a jury verdict.
