A recent Pennsylvania medical malpractice case, involving the death of a 31-year-old man by heart attack, ended in a mistrial on Wednesday afternoon. After the jury reported they were deadlocked, both parties were able to reach an undisclosed settlement amount subject to the approval of the Mahoning County Probate Court.
The case was filed against a family physician named Dr. Steven Swain, who recently left his practice in Austintown. The family claimed that Dr. Swain failed to obtain an electrocardiogram or a complete medical history in response to the victim’s repeated complaints of chest pain during the final three months of his life. The doctor also failed to refer Coin to a cardiologist, instead diagnosing his condition as a rib-cartilage inflammation. The victim soon died of coronary-artery disease.
When doctors fail to correctly identify a life-threatening disease, patients and their families are forced to suffer the worst possible outcome of a condition that was fully treatable. We trust our doctors to know when we are in danger and offer correct, timely treatment. When physicians fail to uphold the standard medical duty of care, they can and should be held accountable.
