A Louisiana woman recently filed a medical malpractice case against Intuitive Surgical Systems, Inc. – the manufacturers of a surgical robotic device that failed during the woman’s neck surgery. According to the lawsuit, the malfunction occurred when the defective medical device was inserted into her neck.
By contract and agreement, Intuitive Surgical Systems is required to have service personnel available at all times in order to rapidly troubleshoot any malfunctions with the device. However, the hospital was unable to contact a representative to fix the problem. As a result, the woman had to convert her robotic transaxillary thyroidectomy into a traditional surgery, which required opening a long incision in her neck.
In the case, Intuitive Surgical Systems is accused of not only faileing to maintain the defective medical device, but failing to adequately train personnel on proper use of the device, and failing to dispatch a technician in a timely manner.
