Several lawsuits have been filed recently claiming that victims of Traumatic Brain Injury (TBI) are not being provided the community-based care that would allow them to leave their institutions and nursing homes and live in a more integrated setting.
A class-action lawsuit in Boston accuses the governor and several of his officials of breaking federal law by failing to provide adequate services to hundreds of patients with brain injuries. According to the lawsuit, the Americans with Disabilities Act is being violated as this law entitles disabled Americans to live in the most integrated living environment possible. The lawsuit alleges that Massachusetts state- and federally-funded programs exclude people with TBI and deny them access to community programs. The Brain Injury Association of America and four named plaintiffs filed this most recent lawsuit.
