A 66-year-old woman in New York City wheeled herself onto the restraining plate of a New York City bus’s rear lift platform just before it collapsed, causing her to fall off the bus. She suffered fractures in her wrist, nasal, and orbital bones as a result of the bus accident, requiring hospitalization. Four months later, the woman died, although physicians believe her death was not related to her injuries.
The woman’s husband is suing the NYC Transit Authority on behalf of her estate, asserting that their failure to properly maintain the bus’s locking and leveling systems was what caused her injuries. An investigation confirmed that the bus lift was not properly leveled, and that the locking system had failed. The husband’s case was successful, and the jury awarded her estate a verdict of $400,000.
Local government entities have an obligation to keep public transportation safe and adequately maintained.
