A woman from Ashland, Kentucky is suing Taxi Service, Inc. after being injured in a car accident caused by a Yellow Cab employee. In November 2010, the woman was driving in Huntington, West Virginia when a cab driver operating a 2011 Ford Crown Victoria tried to make a U-turn on 9th Street and collided with her vehicle.
In the lawsuit, the plaintiff claims that the cab driver had a duty to use reasonable care while operating the vehicle, but failed in that duty by making an ill-advised turn that resulted in the car accident. As a result of the cabbie’s negligent conduct, the woman was injured and is pursuing compensation for the following damages:
- Medical expenses
- Physical pain and suffering
- Mental pain and suffering
- Diminution of her capacity to enjoy life
- Annoyance and inconvenience
The lawsuit claims that Yellow Cab also had a duty – to supervise the conduct and actions of its employees, and to protect the general public from any harm that their employees might cause. The suit asserts that Yellow Cab was negligent in its hiring, training, and employment of the cab driver who caused the accident, and is therefore vicariously liable for the victim’s injuries.
