Matrixx Initiatives, the manufacturer of Zicam Cold Remedy have stated that they will pay $12 million as a reaction to the 340 lawsuits piled against them, but refuse to admit the damages caused by the spray. According to the Washington Post, Matrixx said that the motion was “not an admission of liability, but rather an effort to end most of the litigation over the homeopathetic remedy.”
Some 400 lawsuits total have been filed against Matrixx since 2003, including numerous victims of the defective product who claim to have lost their senses of smell and taste entirely. All of these victims claim that this loss was due to only one use of the product. Matrixx disregards this claim, blaiming the ansomia on some outside virus.
Matrixx still released a new “control tip sprayer”, which would prevent the gel from being forcefully expelled into the nether regions of the nose where damage could be inflicted. Robert J. Murphy, the Matrixx spokesman, claimed that this new development was “a product advancement that has been in the works since 2001” and is “completely unrelated” to the litigation.
